I think we have a claim to the moon, but not to Mars. I believe you have to land a person.
At the same time space travel and research are supposed to be in an international friendship sort of deal so I don't know if there is any backing to any claims of territory. It seems likely that private interests would colonize space before any government and then a state would sort decide they were the controlling power to "help bring order and prosperity". The US is the most likely candidate, Russia has as much of a state in the moon as us. China would undoubled try its hardest to gain territory. I'd imagine it'd end up an issue in the UN but at the same time international law doesn't bind states technically speaking since no major players have submitted their power to an IO.
