Is there anyway I can still have music on a video, but not have youtube pick it up as a song thats been copyrighted? (im not sure which song im going to use yet)

Check out the list youtube has to choose from. You can add it after you upload it. Also look up some good creative commons music.

I dont believe so, They use the same system as Cineavi which has been haunting me for the last two years.

Provided you aren't using something that nearly everyone else uses, you can fly under the radar up until your video gets really popular and the company themselves calls infringement.
