So get this, my ex (who lives in MA) and his mother decide to use my personal info (ssn, name, etc) to run up one of their bills where they live. I just recieved a collections letter from an NStar electric company on cape cod for over $700 (theres probably more, I have to have the company send me all bills from the account) and I never had any account or electric service through them EVER. (when I lived there in 2006-2009 (I left and moved back to maine in july 09), my ex and I shared a house with his mom and she handled the utilities, All I had was my cell phone at the time) which makes me think that they were doing this the whole time. This final demand notice thing was dated for August 09 but I had left a month earlier and I spent all morning on the phone with the state police here and the company down there where the bill came from, filing id theft paperwork out and other crap. man this sucks, I plan on pressing charges and taking them to court, and my parents attorney said that what they did was a federal crime and they could go to jail for it. I'm really hoping they do. Gargh!!

Thanks, ^^' I just got off the phone with the electric company there and it turnes out they had the account in my name from july 1st 2008 all the way to july of 09 and the 700+ was from several months of late payments (but in MA if there is an infnat under 1 in the home they legally cant shut off the power so I assume my ex sister and law and her kids are now staying with them too and they've just been ignoring the bill). Its just insane, but hopefully once the charges are filed whoever was responsible (weither it be my ex or his mother) will hopefilly be getting jailtime for it and this whole mess gets wiped off my credit report.

I am sorry about you bad luck and you do need to press charges. They committed a crime and have no way out of it now. The system does work most of the time and if you follow it you'll be fine.

Well we were engaged at the time (though it eventually fell apart) and we stayed with his mother because she was a disabled veteran and we were helping her out, and she let us live there in return. He had my information because I was pretty much on my own there and we gave each other our info in case of an emergency. At the time I didnt think anything was wrong with that, especially if we were going to be getting married.
Then he started getting abusive (verbally never physical, and he started cheating on me) and I wouldnt put up with it and I left.

Update: I called the collections agency. They have placed a temporary cancel on the account until the matter is resolved.
I also called the electric company where the bill originated, unfortunatly they were not as helpful. They told me they have no signed documentation for when the account was opened. Just that it was opened on july 1st 08 in my name and that addy in MA. Also that on the 14 of july 09 someone called and switched over the account to another name (though the address was the same), which they refused to give me. I asked them that if someone was transferring an account from one name to another wouldn't they need some kind of consent from the original holder as well as the info on both the new and old holders and the guy on the phone told me no. All that happened was someone called to change the name on the account. As far as I know only the original holder can do something like that right? which means whoever is behind the ID theft had to call them pretending to be me in order to do it. Hence my suspicions that ir was probably my ex's mother that did it. Either way the police will notify me on who it is when they contact the company. May take about a week but so far thats pretty good time wise.
Thirdly, I did some research. Mass. State Law (since the crime happened there the guilty party will be prosecuted there) states that: (updated Jan 09)
Current Laws:
Identity Crime: A person is guilty of identity fraud if he, with intent to defraud, poses as
another person without the express authorization of that person and uses such person’s personal
identifying information to obtain or to attempt to obtain money, credit, goods, services, anything
of value, any identification card or other evidence of such person’s identity, or to harass another.
Violations are punishable by a fine up to $5,000 and/or imprisonment for up to 2 ½ years.
A law enforcement officer may arrest without a warrant any person he has probable cause to
believe has committed the offense of identity fraud as defined in this section.
“Personal identifying information” means any name or number that may be used, alone or in
conjunction with any other information, to assume the identity of an individual, including any
name, address, telephone number, driver’s license number, Social Security number, place of
employment, employee identification number, mother’s maiden name, demand deposit account
number, savings account number, credit card number or computer password identification.
Statute: 266 § 37E:

It gets worse. I JUST checked my email and apparently SOMEONE made an account from overstock.com using my name and ordered a shitload of stuff using my name and when I tried to call the company they could not release any info to me because I didnt have any info to verify the account other than an email addy and then they transferred me to Loss prevention when I said someone may have stolen my information to open the account they put me on hold and eventually hung up on me. I changed my emails password just in case and now I'm trying to get access to the overstock account that is supposedly registered to me but no email are coming in from the pass recovery system. I never made an account with them and I have no effing idea whats going on.

My email is re-secured, and coak, scrubs ripped me off about 400 bucks. That though is dealt with. I blocked paypal from taking money from me regarding that.
Frost: That doesnt sound like a bad idea, XD but if they have to pay my to pay my legal fees as part of my restitution, plus lost waged since i'd have to take time off from work, AND what it would cost me to drive down there, stay in a hotel, AND what you suggested, XD man they'd be broke for years, XD
