My girlfriend had it and he went threw it at her house.

Yeah, not sure about the legality, but even if it was illegal, you don't really have a case.
You gave it to your girlfriend, doing that gives her the right to look through it.
Being a minor, her father has the right to look through any thing she has in her possession because he is her guardian and can "filter" content.
If you willingly gave it to your girlfriend or left it at her house, they can. If it was a mistake, then no.
Then judging by what Sothe said, no he really had no right. Not that it really means anything, adults can do almost anything they want as far as kids are concerned.
As an adolescent, I spent most of my time feeling oppressed by adults.

I'm thinking of this the way I think of WiFi "theft." If it's locked and you break in, you stole WiFi, but if it's unlocked you're giving anyone within range permission to access it. If your ipod is unlocked, there's no reason I should think I don't have the right to go through your stuff other than it being your stuff.
