If an attacker caused a pregnant woman to lose her baby, is it an attempted murder or murder?
I believe it murder. I think the law rules it murder as well in most cases if the woman if far enough along.
Definitely murder
Murder, unless she was in some third-world country where regular abortion operations aren't available, and they had to beat her with a baseball bat to abort the baby, like in family guy :/
But I take it that wasn't the case, so it was murder.
It wasn't "attempted" but actually performed, so IDK why you'd think it would be considered attempted murder.
Manslaughter because it wasn't intentional
It was murder. You can't attempt to kill a baby and do it and say it was attempted murder.
It depends on the state to what law is what. Some states consider a fetus a person, while other states consider it just a fetus. But if it were to be by the law in general it would be considered assault in the first degree. Its not technically murder, although it can be charged as that, but its defined as the highest degree of assault.
If you did have a good lawyer you might get away with no murder charge. But that is most likely never going to happen
the lawyer has no control over what charge is put for unless it is during the plea bargaining process. and even then the DA or the ADA has control which is given to them by higher-ups to make a deal.
a lawyer can only defend you in the judicial process. he cant try to make the charge lesser unless you take a deal.
Did you kill someone's baby?
OnTopic: Depends on the state. Some believe the baby is a person. Plus it depends who you were actually trying to kill, the baby or her.
